In a dramatic escalation within the rapidly evolving artificial intelligence (AI) sector, Elon Musk’s AI startup, xAI, and its associated social network X, have filed suit against tech titans Apple and OpenAI. The suit, lodged in the U.S. District Court for the Northern District of Texas, accuses Apple and OpenAI of colluding to maintain monopolies in both the smartphone and generative AI chatbot markets, stifling innovation and limiting consumer choice.

Allegations of Collusion and Market Manipulation

According to the complaint, Apple has allegedly leveraged its control over the App Store to favor OpenAI’s ChatGPT, which was integrated into Apple products—including iPhones, iPads, and Macs—in a highly publicized partnership in 2024. xAI contends that Apple’s prioritization of ChatGPT in app rankings and search results systematically deprioritizes competing services, such as xAI’s own Grok chatbot, and diminishes the discoverability of so-called “super apps.”

“In a desperate bid to protect its smartphone monopoly, Apple has joined forces with the company that most benefits from inhibiting competition and innovation in AI: OpenAI, a monopolist in the market for generative AI chatbots,” xAI alleges in its filing.

The case comes amid heightened scrutiny on big tech companies, with analysts and regulators increasingly concerned about the consolidation of market power in the hands of a few platforms controlling vast ecosystems of hardware, software, and data. Apple’s App Store policies have long faced criticism from developers who argue that the rules create unfair barriers to entry and limit competition, especially in fast-moving sectors like AI.

The Musk-Altman Rivalry and the Path to Litigation

The lawsuit also represents the latest development in the ongoing feud between Elon Musk and OpenAI CEO Sam Altman. Musk, who co-founded OpenAI in 2015 but left in 2018 over disagreements about the company’s direction, has since positioned xAI as a direct competitor to OpenAI in the generative AI space. xAI’s Grok chatbot, which launched in 2024 and is integrated into the X platform, has aimed to challenge ChatGPT’s market dominance through its more rebellious and conversational approach.

Musk’s concerns over potential monopolistic practices were foreshadowed earlier this month, when he publicly threatened legal action against Apple for what he described as “an unequivocal antitrust violation.” He claimed that Apple’s practices made it impossible for any AI company outside OpenAI to achieve top placement in the App Store. The current lawsuit follows Musk’s previous legal actions, including a 2024 breach-of-contract suit against OpenAI and Altman, which accused the company of prioritizing profit over its original nonprofit mission to develop AI for the “benefit of humanity.” OpenAI has dismissed Musk’s latest move as “consistent with Mr. Musk’s ongoing pattern of harassment.”

Apple has maintained that its App Store is “fair and free of bias,” underscoring that it features thousands of apps from innovative developers using a variety of ranking and editorial signals. The tech giant, which recently reported quarterly revenue of $83 billion (Q2 2025), continues to defend its App Store ecosystem amid global regulatory pressure and a string of antitrust investigations across the U.S., EU, and Asia.

OpenAI, meanwhile, emphasized its commitment to fostering healthy competition in AI. “We continue to prioritize the advancement of AI for the benefit of everyone, while supporting a diverse landscape of developers and partners,” a company spokesperson reiterated. Since its multibillion-dollar investments from Microsoft and other major partners in 2023–2025, OpenAI has secured a dominant position in the generative AI space, powering not only ChatGPT but also enterprise tools and cloud-based applications worldwide.

The xAI legal offensive comes at a time when the AI landscape is more fiercely competitive than ever. Despite Musk’s allegations of suppression, community feedback on X and independent analysis have indicated that other generative AI chatbots, including DeepSeek and Perplexity, have topped App Store rankings at times, suggesting a more dynamic app environment than the suit contends. Still, the ability of truly independent AI startups to scale and gain visibility remains an industry-wide concern, with App Store algorithms and business partnerships increasingly critical to commercial success.

As the ecosystem grows, new entrants such as Anthropic, Google’s Gemini, and Meta’s Llama have joined the race for conversational AI leadership, making the contest for user attention and market share even more heated.
